In the News…
Federal Trade Commission (FTC) Chair Andrew Ferguson sent letters to 24 of the nation’s largest healthcare service companies, reminding them of their legal obligation to provide patients with timely, accurate, and complete pricing information. He also warned that failing to do so can be an unfair or deceptive practice.
Chairman Ferguson stated in the letter, “Price transparency is particularly critical in the hospital and healthcare setting because healthcare is often one of the most significant and financially burdensome costs consumers face.“
The FTC chair said the agency is particularly concerned with protecting vulnerable populations, including rural Americans, seniors, and veterans, many of whom lack access to affordable and transparent healthcare.
“A representation or omission is deceptive under the FTC Act if it is material and would likely mislead consumers acting reasonably under the circumstances,“ Chairman Ferguson highlighted. “An act or practice is unfair if it causes or is likely to cause substantial injury to consumers that cannot reasonably be avoided, and that injury is not outweighed by countervailing benefits to consumers or competition.“
